A - Introduction
These general conditions of sale (hereinafter only "General Conditions") govern the sale of products marketed by "BLOOMINGHEARTS".
All contracts for the purchase of products concluded between the seller ("BLOOMINGHEARTS") and according to the procedures indicated therein, between the seller and the customer, will be governed by these General Conditions.

B - Acceptance of the general conditions of sale

The contract stipulated between "BLOOMINGHEARTS" and the Customer must be considered concluded with the acceptance, even if only partial, of the order by "BLOOMINGHEARTS", which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

If the Customer is a final consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of articles 3 and 4 of the Legislative Decree n. 185/1999 on distance selling.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.

C - How to purchase
1. 1. The Customer decides to purchase the products as described in the relevant information sheets. The technical information faithfully reproduces those of the manufacturers of the goods included in the catalog. "BLOOMINGHEARTS"therefore, reserves the right to modify the technical information of the products to adapt them to those provided by the manufacturers, without any prior notice. It is understood that the image accompanying the description of a product may not be fully representative of its characteristics, and may differ in color, size, accessory products shown in the figure. All purchase support information is intended as a simple generic information material, not referable to the real characteristics of each individual product.

Correct receipt of the order is confirmed byBLOOMINGHEARTSby means of an email response sent to the email address supplied by the Customer.

This confirmation message will contain the date and time of receipt of the order and a 'Customer Order Number', to be used in any further communication with BLOOMINGHEARTS". The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.

In the event of non-acceptance of the order, "BLOOMINGHEARTS" undertakes to promptly notify the Customer.
4.All prices are to be intended as retail prices and do not include 4% VAT which is added to the end of the order on the invoice.BLOOMINGHEARTS"BLOOMINGHEARTS" reserves the right to change prices at any time, without prior notice.
"BLOOMINGHEARTSdoes not guarantee the certainty of assignment of the ordered goods in the event of an error, the product may be returned pending receipt of the correct one.

D - Methods of payment
1. Bank transfer
In case of payment by bank transfer, the order will be sent only when the "BLOOMINGHEARTS" account is actually credited, which must take place within 5 working days from the date of acceptance of the order, once the which the order is considered automatically canceled. The purpose of the bank transfer must include the order ID, which is contained in the email of order

confirmation sent following the completion of the procedure on bloominghearts.it

2.Credit card
The amount relating to the order is charged to the credit card at the time of order acquisition. In the event of cancellation of the order, both by the customer and in the event of non-acceptance of "BLOOMINGHEARTS", the amount will be refunded to the customer's account. The cancellation of the order is possible up to the moment in which the same is not yet being prepared in the warehouse. Having requested the cancellation of the transaction, in no case "BLOOMINGHEARTS" can be held responsible for any direct or indirect damage caused by delay in the failure to release the amount committed by the credit card. At no time during the purchase procedure "BLOOMINGHEARTS" is able to know the customer's financial information. Since there is no data transmission, there is no possibility that this data will be intercepted.

No computer archive of "BLOOMINGHEARTS" "contains or retains such data.

E - Delivery methods
"BLOOMINGHEARTS" can accept orders only for delivery in the territory of the Italian state and countries of the European Community.
For every order placed on bloominghearts.it, "BLOOMINGHEARTS" will issue an invoice for the material shipped. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after it has been issued.

Shipping costs are charged to the customer and are explicitly highlighted at the time the order is placed. The payment of the goods by the Customer will be made using the method chosen at the time of the order. No additional fees or commissions are due to "BLOOMINGHEARTS". The delivery of the ordered goods is intended to the home floor up to a weight of 10 kg. The goods travel with packaging made directly by the manufacturer or in cardboard boxes. The delivery times of the ordered goods are purely indicative; they may undergo changes due to force majeure or due to traffic and road conditions in general or by act of the Authority. Standard delivery, unless otherwise agreed in writing between the parties, will take place at the following times: from 9.00 to 13.00; from 2.00 pm to 6.00 pm, every day, except holidays, from Monday to Friday. No responsibility can be attributed to "BLOOMINGHEARTS" in case of delay in order fulfillment or delivery of the ordered goods. Upon delivery of the goods by the courier, the Customer is required to check: - that the number of packages delivered corresponds to what is indicated on the invoice; - that the packaging is intact, not damaged or wet or, in any case, altered; Any external damage or the mismatch in the number of packages or information must be immediately reported to the courier making the delivery, adding the wording "withdrawal with reserve" on the appropriate accompanying document and confirmed, within 8 days by registered mail with receipt of return to the courier, whose address is specified on the accompanying document. In the specific case of a damaged package, write "withdrawal with reserve because the package is damaged". The opening of an anomaly file at "BLOOMINGHEARTS" is also required. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what was delivered. Even if the packaging is intact, the goods must be checked within eight days of receipt. Any report beyond the aforementioned terms will not be taken into consideration. For each declaration, the Customer assumes full responsibility for what is declared.

F - Order processing and delivery times

Order fulfillment times - "Order fulfillment times" means the time interval that elapses from completion of the order to delivery of the product to the courier.

The average timing of goods procurement is present for each product; this parameter is subject to change according to the updated availability of the supplier and can change without notice.

Terms of payment -

Credit card immediate payment;

Advance bank transfer receiving credit on "BLOOMINGHEARTScurrent account 4-6 days.

Depending on availability The courier's delivery times are specified on the respective websites.

G - Delivery costs
1. Delivery costs by express courier, the costs indicated are valid for the whole Italian territory.
The cost of shipping is expressly indicated, it is calculated according to the weight of the products.

H - Right of withdrawal
1. 1. Pursuant to art. 64 and following of Legislative Decree no. 206/2005, if the Customer is a consumer (ie a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a reference to the VAT number in the order form to "BLOOMINGHEARTS") , has the right to withdraw from the purchase contract within 10 working days of receipt.

I – Guarantees
1. 1. All products marketed by “BLOOMINGHEARTS” are covered by the manufacturer's conventional warranty and by the 24-month warranty for lack of conformity, pursuant to Legislative Decree no. 24/02. To use the warranty, the Customer must keep the invoice (or DDT) that he will receive together with the purchased goods.

No damage can be requested from "BLOOMINGHEARTS" for any delays in carrying out repairs or replacements of products under warranty.
In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, it is recommended, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly to the original product packaging should be avoided.

L - Privacy
1. 1. The personal data requested when placing the order are collected by "BLOOMINGHEARTS" and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the Customer and will in no case or for any reason be transferred to third parties . "BLOOMINGHEARTS" guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree N. 196 of 30.06.03. The data controller is "BLOOMINGHEARTS", in the person who from time to time has the legal representation, unless a manager is appointed pursuant to art. 29 of Legislative Decree. n. 196/2003. The customer, at any time, has the right to withdraw consent to the processing of personal data with written communication to be sent to the registered office of "BLOOMINGHEARTS". To the customer, who declares to have received the information pursuant to art. 13 and on the rights due to the same, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data in the manner provided therein. Marketing communications will be sent only with the explicit consent of the Customer issued together with the authorization for processing and submission in the online registration form.

M - Complaints
1. 1. Any complaint must be addressed to "BLOOMINGHEARTS"BLOOMINGHEARTS"

N - Jurisdiction and applicable law
1. 1. The sales contract between the customer and "BLOOMINGHEARTS" is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Milan.

O - Conditions
1. 1. The conditions contained in this document may be modified by "BLOOMINGHEARTS" without prior notice.

I Prezzi

I prezzi di ogni articolo si intendono sempre IVA COMPRESA. Qualora intervenissero, in periodi successivi alla data di stampa dei cataloghi, mutamenti nelle aliquote IVA e nelle altre imposte indirette, verranno applicate in più o in meno le corrispettive variazioni ai prezzi.

Le spese di trasporto, quando previste, in quanto contributo forfettario, sono anch’esse soggette a IVA ordinaria.

I prezzi indicati nel sito sono quelli che il Cliente deve concretamente pagare con la sola aggiunta del contributo fisso per le spese di spedizione, indicato direttamente nella procedura d’ordine per qualsiasi ordine e qualsiasi destinazione in Italia.

Garanzia

Gli articoli sono coperti da una garanzia che ha durata di anni 2 (due), ai sensi dell’art. 128 e seguenti del Codice del Consumo.

Diritto di Recesso

Ai sensi dell’art. 64 e seguenti del D. Lgs. 206/2005, (Codice del Consumo), il Cliente ha diritto di recedere dal contratto di acquisto per qualsiasi motivo e senza fornire spiegazioni, alle condizioni di seguito esposte. Per esercitare tale diritto, il cliente dovrà contattare il nostro servizio clienti tramite qualunque modalità indicata nella sezione “CONTATTI” del sito e richiedere il “Nr di autorizzazione al reso” (RMA). La merce dovrà poi essere restituita a cura e spese del cliente entro 10 giorni dalla data di consegna della merce stessa. Provvederemo alla restituzione dell’importo pagato per l’acquisto della merce restituita inviando un “assegno di traenza” non trasferibile e nel caso di pagamento a mezzo carta di credito, allo storno dell’importo addebitato e comunque entro 30 giorni dalla data in cui siamo venuti a conoscenza del recesso.

Ordine

La merce viene spedita al cliente con imballo gratuito ed è accompagnata da un BUONO DI CONSEGNA oppure, a richiesta, da FATTURA ACCOMPAGNATORIA che riporta l’elenco di tutti gli articoli spediti. La fattura deve essere richiesta al momento dell’ordine, comunicando il numero di Partita I.V.A. In nessun caso saranno emesse fatture successivamente alla spedizione del materiale.
